These are the parts of a property contract that cause the most trouble after it is signed.

Cooling-offWhether you have a cooling-off period, how long it lasts and what it costs to use it.
Section 10.7 certificateThe council planning certificate attached to the contract, and what it tells you about the land.
Inclusions and exclusionsWhat stays with the property, and what the seller can take.
Settlement datesWhen you must pay the balance, and what happens if you or the other side are late.

7 things to check before you sign

Before you sign a contract or bid at auction, check these points. Leave your details and I will email you the full checklist.

  • Special conditions added to the standard contract
  • Deposit amount and how it is held
  • Cooling-off rights, and when you do not have them
  • Settlement date and what happens if it is late

Questions

What does conveyancing cost?

I quote a fixed fee for your matter, not an hourly rate that grows and not an estimate that changes at settlement. You get it in writing, up front. Disbursements such as council and water certificates and searches are listed separately, so you can see what is mine and what is a third party's.

Why use a solicitor instead of a conveyancer?

A licensed conveyancer has to send you to a lawyer once something becomes legal, such as a dispute, a caveat or a difficult special condition. With a solicitor you are already covered.

I am bidding at auction this weekend. Can you help?

Yes. Enquire or book as soon as possible and send the contract. If it is urgent, call 0447 150 899.

Will I deal with you directly?

Yes. No call centre and no rotating file handler. You speak to the solicitor doing the work.

Can we meet in person?

Yes. The office is at 35 Alice Street, Auburn, and I work across Sydney.
